By accessing our website at www.encorepa.org or participating in any of our programs, classes, performances, ticket purchases, or text messaging services, you agree to be bound by these Terms and Conditions. 1. General Terms of Use
By accessing or using our website or services, you agree to comply with all applicable laws and these Terms. Encore reserves the right to update, change, or replace any part of these Terms at any time. Continued use of the site or services constitutes acceptance of those changes.

2. Program Registration and Payment

• All program registrations are subject to availability and confirmation from Encore.

• Full payment is required by the specified due date to secure participation in a class, camp, or production unless otherwise agreed upon.

• Program fees are non-refundable unless a class is canceled by Encore.

• If a participant withdraws after registration, a cancellation fee may apply.

• Installment payments (if offered) must be completed on schedule; failure to do so may result in removal from the program.

3. Ticket Purchases

• All ticket sales are final and non-refundable unless the event is canceled by Encore Performing Arts.

• Encore reserves the right to modify event dates, times, and locations as needed. Ticket holders will be notified of any changes.

• Unauthorized reselling of tickets is prohibited.

4. Communication and Text Messaging (SMS)

• By providing your phone number, you consent to receive informational and promotional text messages from Encore Performing Arts.

• Message and data rates may apply. Message frequency varies.

• You may opt out of SMS communications at any time by replying STOP or contacting us at hello@encorepa.org.

• Your personal information is protected under our Privacy Policy and will not be shared with third parties for marketing purposes.

5. Participant Code of Conduct
Encore Performing Arts is dedicated to creating a safe, inclusive, and respectful environment for all participants. We reserve the right to remove any participant from a program or event for behavior deemed inappropriate, disruptive, or unsafe.

Examples of prohibited behavior include, but are not limited to:

• Bullying or harassment

• Disrespectful language or actions

• Refusal to follow staff instructions

• Endangering oneself or others

Removal due to misconduct will not result in a refund.

6. Intellectual Property
All content, including but not limited to scripts, choreography, music, class materials, and website content, is the property of Encore Performing Arts or its licensors and is protected by copyright laws. Participants and users may not copy, distribute, or use these materials for commercial purposes without written permission.

7. Media Release
By participating in Encore programs, classes, or events, you grant Encore the right to photograph, film, or record you or your child and use these materials for promotional, marketing, and archival purposes, unless a written request is submitted to opt out.

8. Limitation of Liability
Encore Performing Arts is not liable for any personal injury, loss, damage, or theft of personal property that occurs during participation in our programs or events. Participation is at your own risk.

9. External Links
Our website may contain links to third-party websites. Encore is not responsible for the content, policies, or practices of any third-party sites.

10. Indemnification
You agree to indemnify and hold Encore Performing Arts harmless from any claims, damages, or losses arising out of your use of our website, programs, or services, or your violation of these Terms.

These Terms and Conditions are governed by the laws of the State of Utah. Any disputes arising from your use of Encore’s services or website will be handled in the appropriate courts located in Washington County, Utah.
